Is Amanita Muscaria Legal in Your State? 2026 State-by-State Guide
Amanita muscaria is legal to possess and sell in 49 US states as of 2026. Louisiana is the one state with a specific ban. Muscimol and ibotenic acid are not federally scheduled. The wrinkle is that the FDA does not allow amanita as a food or dietary supplement ingredient, which shapes how it can be sold. Here is what that means for you.
Federal status
The Controlled Substances Act does not list amanita muscaria, muscimol or ibotenic acid. The DEA has no scheduling action on them. That puts amanita in a very different bucket from psilocybin mushrooms, which are Schedule I.
What the federal government does say is that amanita is not an approved food additive or dietary ingredient. The FDA has not recognized it as safe for that use. Practically, that means legitimate vendors sell amanita muscaria products as botanical specimens or for research and collection, not as something to eat. Labels that call it a "supplement" or make health claims are the ones that draw enforcement.
Louisiana: the one clear ban
Louisiana passed State Act 159, which prohibits growing, selling or possessing amanita muscaria unless it is strictly for ornamental purposes. The law lumps it in with a list of other plants and fungi. If you live in Louisiana, do not order amanita and do not carry it through the state. Details are on the Wikipedia page on amanita legal status, which tracks changes by jurisdiction.
Every other state: no specific law
Outside Louisiana, no state has a statute naming amanita muscaria, muscimol or ibotenic acid as a controlled substance as of this writing. That covers the big markets like California, Texas, Florida and New York, and it covers everywhere in between.
No specific law is not the same as an explicit green light. A few things to know:
- Analog acts. Some states have broad analog laws. Muscimol is not structurally similar to any scheduled drug, so these have not been applied to amanita, but the language exists.
- Food and health codes. A state health department can pull a product that is labeled as food or makes disease claims. This is a labeling issue, not a legality-of-the-mushroom issue.
- Local ordinances. Cities and counties occasionally restrict "novel psychoactive" retail. Rare, but worth a quick search for your town.
Why 2024 changed the conversation
In 2024 the CDC published a report on mushroom gummies sold in gas stations and smoke shops that sent people to the hospital. When tested, most of the products contained undisclosed psilocin, and some contained kratom, caffeine or ephedrine that was not on the label. Here is the CDC report.
Those products were marketed as "mushroom nootropic" or "amanita" edibles. The actual amanita was not the problem. Adulteration was. But the headlines pushed several state legislatures to look at mushroom edibles, and that is the pressure that could produce new laws.
The takeaway for anyone who uses amanita: this is exactly why lab-tested dried caps and a COA-backed 15:1 extract are safer choices than a mystery gummy. If the industry polices itself, the bans stay rare.
Quick reference by region
Northeast (NY, NJ, CT, MA, PA and neighbors): No specific law. Sold openly in smoke shops and online.
Southeast (FL, GA, NC, SC, TN, AL, MS): No specific law. Florida has had proposed bills that did not pass.
Louisiana: Banned except ornamental. Do not ship there.
Midwest (OH, MI, IL, IN, WI, MN, MO): No specific law.
Southwest and Mountain (TX, AZ, NM, CO, UT, NV): No specific law.
West Coast (CA, OR, WA): No specific law. Oregon's psilocybin program does not cover amanita.
Alaska and Hawaii: No specific law.
The same goes for amanita pantherina and for muscimol isolate: no state names them either.
Laws change. Check your state legislature's site or the Wikipedia page above before assuming anything, and check again if you move.
Shipping and travel
Ordering online is the norm now, and most vendors that sell tested extract or caps ship to every state but one.
Domestic shipping of dried caps and extracts within the US is legal everywhere except into Louisiana. Most reputable vendors block Louisiana addresses at checkout. Flying with dried caps inside the US is generally fine, since TSA is not looking for it and it is not controlled, but do not bring it across an international border. Many countries, including the Netherlands, Australia and Thailand, restrict or ban it.
What "legal" does not cover
Legal to possess is not the same as legal to sell as food. It is also not a statement that the mushroom is harmless. Amanita muscaria has real effects and a real dose curve. Traditional preparation matters, which is why we wrote up amanita preparation methods and what a fully decarbed amanita is. Products like muscimol isolate exist so people can measure instead of guess.
Quick FAQ
Is amanita muscaria legal in Florida?
Yes. Florida has no law specifically restricting amanita muscaria, muscimol or ibotenic acid. Bills have been introduced in past sessions but none have passed as of 2026.
Can I grow amanita muscaria at home?
Legally, yes outside Louisiana. Practically, no. Amanita muscaria is mycorrhizal, meaning it grows in partnership with living tree roots, and nobody has cultivated it reliably indoors. Wild harvest and dried caps are how the mushroom actually reaches people.
These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure, or prevent any disease. Amanita products are sold for adults 21 and over only.
